MDD was retained by legal counsel for insurers regarding a cancellation of a global tour for a music band.
The band had completed 2 out of a total of 4 legs of the tour. After the second leg of the tour, the lead singer became ill and it was determined that he required surgery and the remainder of the tour had to be cancelled. In the subsequent year, the band went on tour again, claiming that it was not a reschedule of the cancelled tour.
Our role included reviewing insurance policies and venue contracts regarding artist guarantees for each cancelled show. We also conducted an analysis of the original tour and the tour that occurred one year later, including a comparison of the show locations and venues. Furthermore, we conducted a trending analysis of tickets sales of the shows that were completed prior to the loss and tickets sales that had already occurred for the cancelled portion of the tour.
