Our firm was engaged by an independent adjusting firm and insurers to review the economic damages claimed in relation to a production loss on a major television series. The production was delayed due to extreme flooding that occurred near the shooting location. The claim for damages resulted from the film sets being destroyed by the flooding and a civil authority being implemented for the area, restricting access to the film locations. Once filming resumed, the production schedule had to be modified resulting in further delays.
Our role included analyzing the payroll records provided to ensure that members of the crew had time off without pay during the affected period in accordance with the force majeure clause dictated by the union. Based on our review, we made an appropriate determination of the additional costs incurred as a result of the delay versus the normal costs that would have been incurred in any event.
