Expropriation – Farm Retail Store

We were retained to critique claims for business losses of a farm that had planned to open a retail store onsite; as a result of a planned expropriation, the store never opened.

As part of our work, we performed research on the planned business that indicated that changes in provincial regulations would have rendered the proposed business much less profitable than projected.

We provided counsel for the authority with a critique of the claimant’s damages model as well as our own calculations of lost profit. The matter settled on the eve of the OMB hearing for a fraction of the claim.
